988LETTERS FROM QADIANI GROUPS RE: SUPPLY OF TAPES AND ADVANCE NOTICES OF QUESTIONS IN CROSS EXAMINATION
(قادیانی گروہوں کے خطوط، ٹیپس کی فراہمی اور جرح کے سوالات کا پیشگی نوٹس)

Mr. Chairman: Before they are called, two letters have been addressed to the secratary, National Assembly, by Mirza Mansur Ahmed, Nazir-e-Aala, Sadar Anjumane, Ahmadiyys Pakistan, Rabwah. One for the supply of the tape, and the other. I will read it.
Of the tape, that. I have refused in any Chamber. At present it cannot be granted to any person beacause our proceedings are confidential. The House agree with me?
(جناب چیئرمین: ان (وفد) کے بلانے سے قبل میں بتانا چاہتا ہوں کہ سیکرٹری نیشنل اسمبلی کو مرزا منصور احمد ناظم اعلیٰ جماعت احمدیہ کی طرف سے دو خطوط موصول ہوئے ہیں جن میں سے ایک اجلاس کی کارروائی کی نقل حاصل کرنے کے متعلق تھا جسے میں نے اپنے چیمبر میں نامنظور کردیا ہے۔ اس اجلاس کی کارروائی خفیہ ہے، اس لئے فی الحال اس کی نقل نہیں دی جاسکتی۔ کیا ایوان مجھ سے اتفاق کررہا ہے؟)
Members: Yes. (اراکین: جی ہاں !)
Mr. Mohammad Haneef Khan: Sir, you used the words "at present". I think, not at present, the tape of the Assembly cannot be granted at any time.
(جناب محمد حفیظ خان: آپ نے لفظ فی الحال استعمال کیا ہے، میں سمجھتا ہوں کہ اسمبلی کی کارروائی کا ٹیپ کسی مرحلہ پر نہیں دیا جا سکتا ہے)
Mr. Chairman: At any time. The order is that this time this request cannot be conceded.
(چیئرمین صاحب: کسی وقت بھی۔ فیصلہ یہ ہے کہ جو درخواست اب کی گئی ہے منظور نہیں کی جا سکتی)
Prof Ghafoor Ahmed: Even proceedings should not be given. Not only the tapes.
(پروفیسر غفور احمد: نہ صرف ٹیپ بلکہ کارروائی (کی نقل) بھی نہیں دینا چاہئے)
Mr. Chairman: The proceedings shall be given only to the honourable members, which are ready, which yesterday, I said that they can collect the proceedings.
The Second letter, the operation portion. I read in the House:
"in any opinion, to facilitate the matter and to assist the Committee in reaching a just conclusion, which the Committee so earnestly desires and also in order to be fair to the parties concerned, it would be advisable if the written questions are given in advance and their answers submitted in writing. As a result of our experience in the first session in the Committee, we sincerely believe that had this procedure been adopted earlier, it would have 989saved a lot of valuable time of the House. After all, it is not a criminal proceedings or an ordinary legal cross examination of an accused, an individual or a praty. The Committee is studying a very serious matter involving religious beliefs of millions of people in a grave moment and not only in the history of Pakistan but also in the history of Islam. I would, therefore, be grateful if you please convey our request to the Steering Committee. I am sure, the Committee, realizing the gravity and the seriousness of the issue, would grant our request.
I would love to hear the Attorney- General.
(جناب چیئرمین: کارروائی کی نقول صرف معزز اراکین کو دی جائیں گی۔ یہ نقول تیار ہیں، کل میں نے کہا تھا کہ نقول لے سکتے ہیں، دوسرا خط میں پڑھ دیتا ہوں۔ ’’میری رائے میں کمیٹی کی سہولت کی خاطر اور مسئلہ زیربحث میں کسی مناسب نتیجہ پر پہنچنے کے لئے جس پہ کمیٹی دل و جان سے خواہش مند ہے، یہ مناسب معلوم ہوتا ہے کہ سوالات پیشگی طور پر تحریراً دیئے جائیں اور ان کے جواب بھی تحریری پیش ہوں۔ ہم سمجھتے ہیں کہ اگر یہ ضابطہ پہلے اپنا لیا جاتا تو ایوان کا بہت سا قیمتی وقت بچایا جا سکتا تھا۔ یہ کسی فوجداری مقدمہ کی کارروائی تو نہیں نہ ہی کسی ملزم یا فرد یا فریق پر قانونی جرح ہو رہی ہے بلکہ کمیٹی لاکھوں انسانوں کے مذہبی اعتقادات جیسے اہم معاملہ پر غور کررہی ہے۔ یہ ایک نہ صرف تاریخ پاکستان بلکہ تاریخ اسلام میں بہت ہی نازک مرحلہ ہے اس لئے میں شکرگزار ہوں گا اگر آپ ہماری درخواست سٹیئرنگ کمیٹی کو پہنچا دیں۔ مجھے یقین ہے کہ معاملہ کی اہمیت اور نزاکت کے پیش نظر کمیٹی ہماری گزارش کو منظور کرے گی۔ اب میں اٹارنی جنرل کے خیالات معلوم کرنا چاہتا ہوں)
Mr. Yahya Bakhtiar (Attorney Genral of Pakistan): Sir, the Delegation has come to the Assembly at their own request. They wanted to be heard. If they wanted to be heard, then they will have be present and we will question to elaborate certain points. Now, it is impossible to send questions in advance because, whenever we ask a question there are five, six, ten supplementaries for clarification. That would mean that whatever supplementary question I ask, that have to be given to them in writing. You will give time after that and they will sbmit written reply. If the written replies were to be taken from then, them they would not have come at all. We could have sent a number of questions as interrogatory which they could have answered from Rabwah. But the point was than that thay should clarify the position. And it is not possible, it is physically impossible. Point as far as the hearing in concerned, Sir, I am the first person to give them as much time as they wanted.
Now we are at the fag end of this examination. Whenever they wanted more to answer any question, they have been given the time by you and by the house. There was a break of Days. About fifteen questions they prepared, and answered those yesterday. So I think, this is not a reasonable question nor is it praciticable.
(جناب یحییٰ بختیار: جناب والا، وفد خود اپنی درخواست پر اسمبلی میں آیا ہے۔ وہ اپنا موقف (اسمبلی میں) پیش کرنا چاہتے ہیں، جب وہ ایسا کریں گے یا کرتے ہیں تو پھر ہم ضروری نکات کی وضاحت کے لئے سوالات کریں گے۔ تاہم سوالات پیشگی دینا ممکن نہیں، کیونکہ جب ایک سوال ہوتا ہے تو اس کی وضاحت میں ۵،۶ یا۱۰ ضمنی سوالات کرنے پڑتے ہیں۔ اس کا مطلب یہ ہوگا کہ ضمنی سوال بھی مجھے لکھ کر دینا ہوں گے۔ تو پھر ان کو تحریری جواب کے لئے وقت دیں گے۔ اگر صرف تحریری جوابات ہی لینا مقصود تھا تو پھر وفد کو یہاں آنے کی ضرورت نہ تھی۔ ہم انہیں سوال، سوالنامہ کی شکل میں بھیج دیتے ہیں اور وہ ربوہ سے جواب ارسال کردیتے۔ اہم بات یہ ہے کہ وہ معاملہ کی وضاحت کریں اور یہ تحریری سوال و جواب کی صورت میں ناممکن ہے۔ جہاں تک سماعت کا تعلق ہے، میں پہلا شخص ہوں جو ان (وفد) کو جتنا وقت درکار ہو دینے کو تیار ہوں۔ اب ہم بیان دینے والے اختتام کے قریب ہیں۔ جب بھی انہوں نے کسی جواب کے لئے مہلت کی خواہش کا اظہار کیا ہے توآپ نے اور ایوان نے ان کو زیادہ سے زیادہ وقت دیا ہے۔ ابھی دس یوم کی تعطیل تھی، انہوں نے قریباً پندرہ سوالوں کے جواب تیار کرکے کل پیش کئے تھے، چنانچہ میرے خیال میں (تحریری سوال و جواب والی) درخواست قابل عمل نہیں)
Mr. Chairman: Now, I think, most of the questions are over and the supplementaries are going on.
(جناب چیئرمین: میرے خیال میں بہت سے سوال ہوچکے ہیں …)
Mr. Yahya Bakhtiar: Only on three subjects. And, about every subject, I tell them in advance. That about Akhand Bharat, I am going to ask a few questions; about "their Separatism" I am 990going to ask a few questions; About "Jehad" I am going to ask a few questions; about "Khatme-Nabooat" I am going to ask a few questions and they know the subject.
(جناب یحییٰ بختیار: صرف تین عنوانات کے متعلق اور ہر عنوان کے متعلق میں نے انہیں قبل از وقت آگاہ کردیا تھا۔ یہ (عنوان) اکھنڈ بھارت، علیحدگی پسندی، جہاد اور ختم نبوت ہیں۔ ان عنوانات کے سلسلہ میں کچھ سوالات کرنا چاہتا ہوں، ان کو عنوانات کا علم ہے)
Mr. Chairman: So, is the House of the opinion that request also cannot be granted?
(جناب چیئرمین: کیا ایوان اس درخواست کو منظور کرنے کے حق میں ہے؟)
